The 9th US Circuit Court-of-Appeals has scheduled Freedom Book's Appeal
for February 10th, 2004 at 9 AM. The Court has made an unusual ruling by
allowing 20 minutes for oral argument. Cynthia Neun is very enthusiastic of
the prospect of arguing her case on her own behalf.
On Christmas Eve Cindy filed for Motion-for-Severance from the other
defendants. Cindy¹s case has disparate impact from Irwin¹s and she has no
'case' with the IRS: No assessments, no deficiencies, no anything. So,
for Cindy to have a fair trial on her unique defenses and to shed the
baggage of Irwin's 'res judicata'- not that any of those cases involved the
same statutes or facts, she needed to sever herself from him in all of the
cases working against them in the Courts right now. Thus, prior court
decisions against Mr. Schiff would be more difficult for the government to
argue in Cindy's case.
Although Irwin Schiff is guilty of nothing, except a literal understanding
of the law, there will be no opportunity for the government to invoke a
sort of "guilt-by-association".
Ms. Neun plans to rent transportation for her trip across the desert, over
the mountains and up to San Francisco for the week before the hearing in
the Court of Appeals. She will call upon all of the media in that area and
spend time with the pro se law clerk and other things we do not want to
disclose in this public forum.
